The protection of your privacy is important to us. We process personal data collected from you confidentially and only in accordance with the statutory provisions. According to the General Data Protection Regulation, we are obliged to provide you with the following information when we collect personal data.
In the following, we provide an overview of which data we process from you/you in the context of flea market organisation and coordination as well as flea market visits, on which legal basis this is done and for how long we store this data.

Relevant legal basis
The legal basis for the processing of your personal data is Art. 6 para. 1 lit. b (performance of a contract of which you yourself are a contracting party for our flea market vendors) or Art. 6 para. 1 lit. f. The legitimate interest here is the organisation and coordination of the flea market.
The collection of contact data is based on § 7 Ordinance on the Containment of the Coronavirus SARS-CoV-2 – HmSARS-CoV-2 Containment Ordinance as amended on 11 June 2021.

Your rights
You have the right to obtain information about the personal data we hold about you at any time, as well as the right to rectify, erase, restrict processing, object to and the right to data portability of the personal data you have provided to us. Furthermore, you have the right to revoke any consent at any time.
You also have the right to lodge a complaint with a supervisory authority.

Disclosure of data/recipients
Only the members of the flea market organisation team have access to the personal data. We exclude the transfer of data to third parties for advertising purposes.
If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this happens in the context of the use of third-party services or disclosure, or transfer of data to third parties, this only takes place if it is done to fulfil our (pre-)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we only process or allow the processing of data in a third country if the special requirements of Art. 44 ff. DSGVO are met. I.e. the processing is carried out, for example, on the basis of special guarantees, such as the officially recognised determination of a level of data protection corresponding to the EU or in compliance with officially recognised special contractual obligations (so-called „standard contractual clauses“) or on the basis of your consent.

Duration of storage; retention periods
In principle, we store your data for as long as is necessary for the fulfilment of the purpose, beyond that only if we have to continue to store them in order to fulfil legal obligations (e.g. we are obliged to store documents such as contracts and invoices for a certain period of time due to retention periods under tax and commercial law).
The contact data collected from you on the basis of § 7 Ordinance on the Containment of the Coronavirus SARS-CoV-2 – HmSARS-CoV-2 Containment Ordinance will be deleted or destroyed after four weeks.

Use of providers for electronic contact data collection
You have the option of either collecting your contact details in analogue/written form when visiting our flea market, or checking in via QR code with the Luca app or the RKI’s Corona warning app.
